Terms of Sale
Customers
are urged to read and print out this entire Agreement, Terms
of Sale. By checking the box during their checkout
process, customers acknowledge this Agreement and agree
to abide by it. If the customer does not agree to
the terms of this Agreement, he/she must cancel the completion
of his/her order.
PAYMENT
Visa,
MasterCard, Discover, money orders. For your privacy, eSales,
Inc. is the name which will appear on your credit card statement.
Credit card orders by fax/mail or internet only. Due to
the large volume of credit card fraud, your billing address
is required and will be checked thoroughly with the issuing
bank. Please include the telephone number of the bank that's
listed on the back of your credit card. We can only ship
to the billing address of the card holder. If you
would like your order to ship elsewhere, please contact
your credit card company and list an alternate shipping
address with them. This can be accomplished by
calling the 800 number on the back of your card. Because
most orders ship the same day they are placed, except weekends
(if placed by 1:00 PM PDT) credit cards are charged immediately
at the time of transaction. If a customer must cancel
an order immediately after placing it, it MUST be cancelled
prior to 1:00 PM PDT that same day to avoid a cancellation
fee in the amount of 3.5%. Once the order has shipped,
no refunds will be issued.
SHIPPING
Most
Orders are shipped the same day they are received if placed
by 1:00 PM PDT. Special order and out of stock items usually
ship within 72 hours. Orders are generally shipped via ground,
insured delivery for $8.95 per order. If the order is extremely
heavy, we may contact you with additional shipping fees.
Please be sure to put your correct phone number on your
order. Please do not use P.O. Box addresses, unless
the credit card is issued to that address, they will be
returned. (route/box addresses in rural areas are acceptable).
Alaska,
Hawaii, and Puerto Rico orders will be shipped by air delivery.
Add $15.00 shipping fee in addition to the standard shipping/handling
fee.
Second
day air and next day air delivery are available at additional
costs. Rates are printed on our order form. Please add to
our standard shipping/handling fee.
Overnight
deliveries shipped on Friday will not arrive until Monday.
Saturday
and Sunday deliveries may be available, Please call for
quote.
Under
no circumstances shall esales, Inc. be responsible for its
failure or delay in delivering products or services in fulfillment
of accepted orders, when such failures or delay is due to
reasons beyond eSales, Inc.'s control.
FOREIGN
ORDERS
All
foreign orders (except Canada) must call/fax for shipping
quote. Minimum foreign order is $100.00 of merchandise.
Foreign orders are generally shipped U.S. Airmail or Federal
Express, at our option. You are wholly responsible for any
custom duties, import restrictions, etc. All payments must
be made by bank money order in U.S. funds. For wire/funds
transfer, please contact our office by fax for our banking
information. No L/C will be accepted.
Canadian
orders are generally shipped by U.S Postal Service and you
must add a shipping fee of $20.00 in addition to the standard
shipping/handling fee.
PRIVACY
Due
to the nature of our products, many customers wish to keep
their purchase of surveillance equipment confidential.
We respect the wishes of our customers by refraining from
putting our SpySupplyStore logo on any paperwork enclosed
within your order or on the packaging and credit card statements.
If we need to contact you by telephone regarding your order,
we identify ourselves as eSales, Inc and we do NOT mention
the content of your order. We also attempt contact
via email. Confidentiallity is crucial in our business.
SECURITY
eSales,
Inc uses a Secure Server to protect its customer's credit
card numbers during their check out process. eSales,
Inc also uses special CREDIT CARD FRAUD PROTECTION software
that captures the IP address which, in the event of the
fraudulent use of someone's credit card, identifies the
computer used by the buyer. This captured IP address
is only used to prosecute credit card fraud. It is
NOT used to track customers, or
send unsolicited emails of any kind.
RETURN POLICY
All
products are special ordered by the person ordering, and
are NOT subject to cancellations. Due to the nature of our
product line, some items may be used once, and no longer
needed. For this reason, ALL SALES ARE FINAL! If
defective, we will replace unit with a new exact item or
repair at our option. Any return MUST be authorized by eSales,
Inc. and under no circumstances
will refunds be given unless so authorized. Authorization
and shipping instructions must
be obtained from eSales, Inc. by calling 1-702-349-9185.
Returns are NOT to be sent to our
Las Vegas office, as additional shipping costs to forward
the package to the proper location will be the responsibility
of the customer. Once the unauthorized return is forwarded,
it will then be held until return shipping is paid by customer
by money order only. If Return is
authorized, the product(s) must be returned via UPS or U.S.
mail, signature required, with RMA clearly posted on
outside of box, prepaid and insured, for your protection.
The Return Authorization number given by eSales MUST be
written clearly on the outside of the box. (Please
note, we will NOT refund shipping fees). No returns will
be authorized after five (5) business days of receipt for
any reason, unless defective, upon which will be exchanged
for like item or repaired at our option. No discontinued
item may be returned. In the extremely unlikely event we
accept a return it will be subject to a 25% restocking fee
plus shipping. Purchases which were made by credit card
will be assessed an additional 3.5% processing fee.
NO REFUNDS UNDER ANY CIRCUMSTANCES!
eSales, Inc. at it's option may send out the replacement
part prior to receiving the defective item. In these circumstances
all defective products must be returned to eSales, Inc.
within 10 days of receiving the replacement part. All defective
parts that are not returned to eSales, Inc. within the 10
day limit will be charged full price for the second item.
WARRANTY
We
guarantee all SpySupplyStore.com products to be free of
defects in workmanship and material for 90 days after sale
to customer. We will replace or repair, at our option providing
there is no evidence of customer misuse, or alteration.
Most products have a 1 year, or longer, manufacturers warranty
also included.
LEGAL STATUS OF PRODUCTS
It is the responsibility of the Buyer (not eSales, Inc.)
to ascertain and obey all applicable local, state and federal
laws in regard to possession and use of any item in this
catalog. Consult your attorney regarding local, state and
federal laws before ordering. By placing an order, the buyer
represents that he/she is of legal age and that the products
will be used only in a lawful manner.
Federal law requires that
one party to a conversation consent to a recording thereof.
Consult your attorney for applicable state laws.
Indemnification:
By making this purchase, and checking the box during the
check out process, Buyer hereunder agrees to indemnify
and hold harmless eSales, eSales shareholders, directors,
officers, employees, representatives and agents, all of
eSales affiliates and all Representatives of all eSales
affiliates from and against any and all lawsuits, losses,
actions, causes of action, damages, charges, penalties,
costs, governmental duties, expenses or obligations of
any kind or nature whatsoever (including reasonable attorney
fees and costs of defense) arising, relating to, or alleged
to arise or relate to the actions or inactions of Buyer
in connection with this Agreement and/or goods or services
to be provided by eSales within this Agreement. This indemnification
obligation will continue after cancellation or termination
of this Agreement.
MISCELLANEOUS
Once orders are settled (11 PM Pacific Time daily), in the rare instance we allow a cancellation, there will be a fee of 3.5% unless the order was paid for by check, money order or wire transfer. Orders cancelled after this settlement period will be charged a 3.5% cancellation. International payments will be assessed an additional 1% fee as Canadian credit cards cost more to process. If time is of the essence, and you need your item witin a certain time frame, it is in your best interest to contact eSales Inc at 702-349-9185 to be sure the item you are ordering is in stock. Some items are custom made and may not ship immediately. To prevent processing an order that you may later want to cancel, you must contact eSales at 702-349-9185 PRIOR to placing your order to be sure the item(s) you are ordering are in stock. There will be no cancellations for orders delayed for being out of stock temporarily. Orders may be cancelled w/o fee if the item is no longer available.
Due
to special requirements, Lock Picks will NOT
be shipped until Authorization
Form is Filled Out, Signed, Dated and returned to eSales
Inc. via the instructions on the form.
Prices
are subject to change. Product styles may vary. Since
products are always being improved and modernized by manufacturers,
eSales cannot issue refunds because the product you get
looks slightly different than what our website depicts.
Nevada
orders must add applicable sales tax. If tax exempt, please
include a resale certificate.
We
assume no liability associated with product usage. The buyer
is liable and responsible for any loss, damage or expenses
of any kind, arising out of the use or misuse of these products.

By
placing a check mark in the box during checkout, the buyer
signifies agreement to these Terms of Sale.
